ПРОБЛЕМ ОБЈЕКТА ЛЕГИТИМИТЕТА У СОЦИОЛОШКО – ПРАВНИМ ИСТРАЖИВАЊИМА

Сажетак

Иако традиционално политиколошка тема, легитимитет је последње три деценије постао предмет интересовања и истраживача из области социологије права који се баве питањем усклађености понашања са правом. Значајне разлике међу истраживачима у овој области, најпре у погледу дефинисања појма легитимитета, а затим и у његовој операционализацији, често доводе до немогућности поређења резултата различитих студија. У циљу стварања јаснијег концептуално-методолошког оквира за нека будућа социолошко – правна истраживања легитимитета, мапирали смо три теме у вези са којима се јавља највише нејасноћа: 1. објекат легитимитета, 2. операционализација појма легитимитета у емпиријским истраживањима, 3. основ легитимитета. Овај рад посвећен је проблематизацији прве теме. У њему се методом концептуалне анализе настоји истражити који су објекти легитимитета релевантни за истраживање правног понашања. Прегледом литературе која се на теоријски начин бави легитимитетом, као и значајнијих емпиријских истраживања, у раду смо дошли до тога да постоје три могућа објекта легитимитета: 1. институције, 2. правни акти, и 3. званичници система. Пошто поштовање закона може произаћи из легитимитета сваког од ова три објеката, за социологију права важно је да за сваки контекст емпиријски истражи легитимитет којег од њих служи као примарни мотиватор за понашање.
