ОДГОВОРНОСТ ДРЖАВА УГОВОРНИЦА ЗА МАТЕРИЈАЛНУ ШТЕТУ ПРОУЗРОКОВАНУ ПОВРЕДОМ ЕВРОПСКЕ КОНВЕНЦИЈЕ О ЉУДСКИМ ПРАВИМА
Сажетак
Циљ овог рада ограничен је на разматрање одговорности држава уговорница за материјалну штету проузроковану кршењем Европске конвенције о људским правима као један од облика новчаног правичног задовољења оштећеној страни. За постојање одговорности држава за ову врсту штете неопходно је да кумулативно буде испуњено неколико услова. Ти услови нису ближе регулисани Конвенцијом, већ их је самостално, ослањајући се на национална одштетна права држава уговорница, формулисао Суд у низу случајева. Из досадашње судске праксе произилази да они подразумевају: противправни акт државе којим се крши Конвенција или протоколи уз њу; проузроковање материјалне штете; и постојање узрочно-последичне везе између таквог понашања и проузроковане штете. Разматрање поменутих услова за одговорност држава уговорница Конвенције главни је предмет пажње аутора овог рада.
