Сажетак

Предлог Споразума о стабилизацији и придруживању (ССП) између Европске уније (ЕУ) и Европске заједнице за атомску енергију, с једне стране, и Косова*, с друге стране (ССП са Косовом), покреће бројна питања која се тичу статуса Косова. Будући да Косово није држава у смислу међународног права нити се, како је предвиђено ССП-ом са Косовом, закључивањем овог споразума прејудицира позиција чланица по питању статуса Косова нити представља признање Косова, као кључно, поставља се питање правног основа за закључење ССП-а, будући да је чл. 217 Уговора о функционисању ЕУ закључивање споразума о придруживању резервисано за државе и међународне организације. Аутор разматра и питање улоге (могуће) УНМИК-а и Републике Србије у поступку закључења ССП-а са Косовом и питање последица закључења овог споразума на одређивање коначног статуса Косова.
