ПРАВО НА ИМОВИНУ У КОНТЕКСТУ ЉУДСКИХ ПРАВА СА ПОСЕБНИМ ОСВРТОМ НА ПРАКСУ ЕВРОПСКОГ СУДА ЗА ЉУДСКА ПРАВА

Сажетак

Члан 1 Протокола 1 Европске конвенције о људским правима штити фундаментално право на мирно уживање имовине. Ово право подлеже ограничењима, чија се прихватљивост процењује у сваком конкреном случају на основу теста од шест питања који је утврдио Европски суд за људска права. Рад се бави анализом случајева у којима је Суд, применом наведеног теста, утврђивао повреду члана 1 Протокола 1 Европске конвенције о људским правима. Методом синтезе постојећих теорија из области заштите права на имовину, дескриптивним методом и методом анализе садржаја релевантне праксе Европског суда за људска права дошло се до закључка да је Европски суд за људска права, по правилу, налазио кршење права на имовину уколико мере које је држава предузела у конкретном случају нису биле у јавном или општем интересу, пропорционалне или легалне.
