УЛОГА ОДЛУКА САВЕТА БЕЗБЕДНОСТИ УН У СТВАРАЊУ МЕЂУНАРОДНОГ ПРАВА

Сажетак

Улога одлука органа Уједињених нација (УН) у стварању међународног права углавном се разматра као утицај на формалне изворе међународног права. У тим оквирима промишљања одлуке Савета безбедности УН (СБУН) само посредно доприносе настанку или промени међународног права, док је њихов непосредни правностваралачки ефекат ограничен на конкретну ситуацију на коју се односи. СБУН је услед промена у међународним односима направио искорак ка стварању општих међународноправних норми. Зато смо одлучили да размотримо како доктрина међународног права види домете тог легислативног утицаја. Рад анализира тачке спорења доктрине и разматра непосредни правностваралачки утицај одлука СБУН из угла међународноправног субјективитета међународних организација. Закључак аутора је да је легислативна активност СБУН стварност која отвара могућност развоја УН као субјекта међународног права, али истовремено прети да поремети темеље међународноправног поретка.
